    1. General, scope of validity

      • The following General Terms and Conditions (hereinafter “GTC”) govern the contractual relationship between the Federal Office of Topography swisstopo (hereinafter ”swisstopo”) and all individuals and legal entities who use the “mySwissMap” service to generate a customised national map (hereinafter “Purchaser”). Conflicting or deviating terms and conditions on the part of the Purchaser shall only be binding if swisstopo has accepted them in writing.
      • The GTC apply to all orders placed by the Purchaser. The Purchaser agrees to the following GTC by transmitting digital data to swisstopo or by clicking on the field labelled “I have read and hereby accept the GTC” or similar on the web interface for ordering personalised map products.
      • The GTC apply only to the use of the “mySwissMap” service. This service is operated in cooperation with swisstopo and MapSherpa. The contractual partner upon conclusion of the purchase is swisstopo.
      • swisstopo reserves the right to amend the GTC at any time. The version in force at the date of conclusion of the contract shall always be authoritative.
      • Should any provision of these GTC be or become invalid or unenforceable, the remaining provisions of these GTC shall remain unaffected, unless the omission of individual clauses would place a contracting party at such an unreasonable disadvantage that it can no longer be expected to adhere to the contract.
    2. Conclusion of the contract

      • By clicking on the order button, the Purchaser places a binding order for the goods contained in the shopping basket. Before submitting the order, the Purchaser has the opportunity to check the accuracy of the items added on an overview page and to correct them, if necessary.
      • swisstopo reserves the right to reject orders received within 3 working days if there is reason to suspect that the rights of third parties or legal regulations being violated. In particular, orders containing pornographic, extremist or other offensive content will be rejected. The assessment is the sole responsibility of swisstopo. There is no legal claim to the conclusion of a contract.
      • Orders are generally processed within 3 working days.
    3. Delivery and dispatch

      • Delivery shall be made by sending the goods to the address provided by the Purchaser. The invoice address and the delivery address may differ.
      • Dispatch generally takes place within 2 to 3 working days of receipt of the order confirmation by the Purchaser. Outside Switzerland, delivery usually takes 1-3 weeks. This information is not binding. Late arrival of goods does not entitle the Purchaser to refuse delivery.
      • Delivery shall be made by a shipping service provider chosen by swisstopo. Packaging and transport costs are included in the shipping costs which are to be paid simultaneously with the payment of the goods during the order process. The conditions for swisstopo publishing products apply and can be viewed at www.swisstopo.ch. Special offers and individual agreements remain reserved.
      • For technical reasons, an order may be divided into several delivery units. The delivered goods must be inspected by the Purchaser for damage immediately upon receipt. Any defects must be notified within 2 weeks (by e-mail to mapsales@swisstopo, or by letter), otherwise the goods shall be deemed to have been accepted.
    4. Prices
      Prices are shown as gross prices, i.e. including VAT. The shipping costs are listed separately on the invoice in accordance with paragraph 3.
    5. Payment, due date, default on payment
      Payment is by invoice (only within Switzerland) or made in advance by credit card or Twint. swisstopo reserves the right to change the choice of payment methods depending on the order value, shipping region or other objective criteria.
    6. Transfer of ownership
      The goods remain the property of swisstopo until payment has been made in full.
    7. Right to withdrawal

      • swisstopo is entitled to withdraw from the contract at any time without stating a reason. swisstopo may also withdraw from an outstanding part of the delivery or service if false information has been provided about the creditworthiness of the Purchaser or if objective reasons have arisen concerning the Purchaser’s inability to pay.
      • The “mySwissMap” offer is a customised offer created specifically for the Purchaser on the basis of the details and selection provided by the Purchaser. Therefore, the Purchaser has no right of withdrawal after completion of the order. This also applies in the event of dissatisfaction.
    8. Warranty

      • Details, illustrations, technical data, and dimensions specified on the website, in brochures or on price lists are for information purposes only. swisstopo accepts no responsibility for the accuracy of these details. With regard to the type and scope of the service, only the information contained in the order confirmation is binding.
      • If the goods are defective on receipt, swisstopo will provide a replacement delivery. Defects must be reported to swisstopo in writing within 2 weeks. In all cases, the Purchaser shall return the defective goods to swisstopo.
      • The warranty does not cover typing errors entered by the Purchaser, images of insufficient quality (e.g. due to poor image resolution), design errors for which the Purchaser is responsible, incorrect product selections, incorrect order quantities or any other defects arising from errors made when inputting the order.
    9. Limitation of liability

      • The liability of swisstopo shall be governed by the legal provisions unless these GTC provide otherwise. In principle, swisstopo is only liable for intent and gross negligence.
      • The limitations of liability of these GTC also apply to the personal liability of swisstopo’s employees and subcontractors.
      • The availability of the shop is guaranteed on a “best effort” basis. However, interruptions to service cannot be ruled out. swisstopo is therefore not liable for the constant availability of the web shop.
    10. Copyrights to print designs, release from liability

      • If the Purchaser submits their own motif or otherwise influences the goods (customisation), they thereby confirm to swisstopo that the text and motif are not exempt from third-party rights. In this case, any infringements of copyright, personal rights or rights to a name shall be borne in full by the Purchaser. The Purchaser also guarantees that they are not infringing any other third-party rights by customising the goods.
      • The Purchaser shall fully indemnify and hold swisstopo harmless from and against all claims and demands asserted on the grounds of infringement of such third-party rights.
    11. Technical, content-related and design-related deviations

      • In fulfilling the contract, swisstopo expressly reserves the right to deviate from the descriptions and information on the website, in catalogues and on the price list with regard to material quality, colour, dimensions, and design, insofar as these are not unreasonable for the Purchaser.
      • Due to the printing techniques and the printing material used, swisstopo also assumes no guarantee for the durability of the print during use of the goods.
      • With regard to the status of the map content, deviations from maps published on map.geo.admin.ch or on other portals and from printed products on sale are to be expressly accepted by the Purchaser. Deviations may result from different updating and refreshing processes for the various swisstopo offers.
    12. Data protection

      • Legal basis
        The handling of personal data is governed by the Federal Act on Data Protection (FADP, SR 235.1) and the Ordinance on Data Protection (DPO, SR 235.11).
      • Data processing and disclosure
        The data processing directory pursuant to Art. 12 FADP can be viewed on the website of the Federal Data Protection Commissioner FDPIC. In order to process the order within the scope of the “mySwissMap” products, the personal data required for this purpose is transferred abroad (Canada) to a third-party company which operates the service for creating the mySwissMap printed data (Art. 16 FADP). The protection of this data is contractually regulated with the third-party company. This data is not passed on to third parties and is not used for purposes other than to fulfil the “mySwissMap” service.
      • Information automatically stored when visiting our websites
        When accessing our websites, the following data is stored in log files: IP address (i.e. the unique address that identifies your computer on the internet), date, time, browser request and general information transmitted about the operating system or browser. According to the Federal Act on the Surveillance of Post and Telecommunications (SPTA, SR 780.1), there is a legal obligation to retain connection data for the last six months.
        We use these IP addresses, which are anonymised in advance, to website maintenance and to collect general demographic information for aggregate use.
        This use data forms the basis for anonymous statistical evaluations to identify trends which we then use to improve our offer accordingly.
      • Use of cookies
        We use cookies on various pages to make visiting our website more attractive and to enable the use of certain functions. These are small text files that are stored on your computer. Most of the cookies we use are deleted from your hard drive at the end of the browser session (so-called session cookies). Other cookies remain on your computer and enable us to recognise you on your next visit (so-called permanent cookies).
        You can prevent the storage of cookies in your browser by restricting or switching off the storage and reading of cookies. These settings can also be applied with all other browsers. Please note that you cannot use certain functions of our website without cookies.
      • What personal data do we collect and why?
        swisstopo maintains a customer database for the mySwissMap shop including the following data:
        Surname, first names
        Username (email address) and password
        Address
        Phone
        Information about products ordered

        Data processing is carried out exclusively for the purpose of ordering and delivering products. Data processing is based on Articles 24 ff. of the Ordinance on Cadastral Surveying (LVV, SR 510.626).
        Your personal data is encrypted during the ordering process and transmitted via the internet using HTTPS (TLS 1.2 128 bit). Credit card details are not stored but are collected and processed directly by our payment service provider, PostFinance AG. We use technical and organisational measures to secure our website and other systems against the loss, destruction, access, modification or distribution of your data by unauthorised persons. Your customer account can only be accessed by entering your personal password. The print data for the entire order, which also contains the Purchaser’s product customisation input, will be deleted after 30 days at the latest.
      • Security
        swisstopo uses the latest technologies to protect personal data from unauthorised access and misuse.
      • Data protection advice
        The swisstopo data protection advisor is the contact person for your enquiries regarding data protection and the right to information at swisstopo.

    13. Ensuring the availability of the systems
      Cloud services such as Amazon Web Services are used to ensure the availability of the systems. This may mean that the personal data used for order processing is stored on servers in the USA and other countries.
      Agreement to these GTC includes agreement to the processing of the Purchaser’s personal data.
    14. Original text
      The GTC are originally written in German. In the event of any contradictions in other language versions, the German version shall prevail.
    15. Jurisdiction
      All disputes arising from this legal relationship are subject to Swiss law. The place of jurisdiction is Berne, Switzerland.
